Causation now the question as closing submissions are coming in the Brayden Bushby trial.
Both the Crown and Defence cross-examined Doctor Toby Rose, the forensic pathologist who performed the autopsy on 34 year old Barbara Kentner back on July 7th 2017.
Rose first taking the stand Tuesday
Based on that testimony, lawyer George Joseph pushed back on the medical opinion of Doctor Rose that the late January injury and complications from that ailment and surgery hastened Kentner’s July death.
When asked by how much, Dr. Rose couldn’t give an exact timeline.
Joseph also inquired whether it’s common for an autopsy to take place with a distant or remote connection between someone’s death and an injury. Rose didn’t give a specific number but stressed it’s more common than you think.
NOTE: A span of over five months between the January 29th incident and the July 4th passing of Barbara Kentner
Dr. Rose’s report suggested it’s very unlikely that liver disease solely contributed to the July 2017 death of Kentner.
The 21-year-old Bushby has pled not guilty to the charge of manslaughter, and guilty to the charge of aggravated assault in the incident.
The court heard she was struck by a trailer hitch thrown from a moving vehicle.
CROSS-EXAMINATION NOTES
- George Joseph suggested to Dr. Rose that it was a span of approximately 17 hours after the injury that Barbara Kentner was brought to the hospital
- Based on the Patient Discharge Record from February 4th 2017 Joseph notes the only restriction that was put on Barbara Kentner was limited lifting
- Joseph pointed out to Dr. Rose that a number of medical practitioners observed signs of jaundice in Barbara Kentner between February 10th 2017 and March 24th 2017
- In an Order Sheet and Progress Notes report from March 4th 2017, Joseph mentioned three issues that the medical professional noted, including spontaneous bacterial peritonitis prophylaxis (an infection of ascitic fluid)
